In a continuing effort to provide the participants with greater program management flexibility while maintaining the integrity and intent of the Market Access Program (MAP), FAS has, over the past few years, revised, corrected and clarified portions of the MAP regulations. Because the entire rule is not published each time there is a revision, some participants are finding it difficult to keep abreast of all the regulatory changes.

Enclosed is a non-published version of MAP regulations that incorporates all amendments to the MAP including those that are effective for the 1998 program year. Please be advised that the enclosed document has not been published in the Federal Register and is intended only as a quick reference guide. For detailed information regarding the specific amendments you must refer to each individual final rule. For your convenience, below is a summary of the most significant changes that are in effect for the 1998 program year:

 
  • The level of export contributions, including brand promotion cost-share contributions made by U.S. industry participants, is incorporated into the MAP allocation process;
  • Reimbursement of certain overseas travel expenses and labeling and design expenses for brand participants is authorized;
  • Reimbursement for certain expenses (other than travel) related to shows conducted in the U.S. is authorized;
  • The activity payment deadline following the end of an activity plan year is extended to 6 months;
  • A 5-year limit, per country, on brand promotions by a single company is established (Note: If a company has been promoting its products in a country with CCC funds since 1994, then the company will no longer be eligible for assistance in that country beginning in 1999.);
  • Reimbursement to participants based upon issuance of a credit memo as an alternative to a transfer of funds is permitted.
