Peanuts
TREATMENT OF TARIFFS:
- U.S. tariffs on peanuts are being phased
out in conjunction with the treatment of quantitative
restrictions.
- Imports of peanuts into Mexico were
already duty-free before the NAFTA.
TREATMENT OF QUANTITATIVE RESTRICTIONS:
- Upon enactment of the NAFTA on January 1,
1994, previously existing U.S. Section 22 import quotas
on Mexican peanuts were replaced by a NAFTA tariff-rate
quota (TRQ), which is being phased out during a 15-year
transition period.
- Mexico initially received a 3,377-ton TRQ
for shelled and in-shell peanuts. This quantity grows by
a 3-percent compound annual rate over the transition
period. The 1998 TRQ is 3,801 metric tons.
- In-quota shipments enter the United States
duty-free. Above-quota imports from Mexico faced an
initial tariff equivalent of 123.1 percent on shelled and
186.1 percent on in-shell. These over-quota tariffs are
being phased out by 15 percent in the first 6 years, with
the remaining tariff to be phased out on a straight-line
basis over the final 9 years.
- Mexico does not have any quantitative
restrictions affecting trade in peanuts.
RULES OF ORIGIN FOR PEANUTS AND PRODUCTS:
- For U.S. trade in peanut products with
Canada, NAFTA origin is conferred on peanut butter and
paste made from non-NAFTA peanuts. Roasting or blanching
of non-NAFTA peanuts does not confer origin.
- For U.S. imports of Mexican raw peanuts,
roasted and blanched peanuts, peanut butter, and peanut
paste, 100-percent Mexican-grown peanuts must be used to
make product that qualifies for NAFTA preferential
tariffs. This same "domestically produced" rule
applies for U.S. exports to Mexico of peanuts and peanut
products.
