I have the honor to confirm the following understanding reached between the delegation of the Government of the United States of America (the "United States") and the delegation of the Government of Israel ("Israel") with respect to the implementation of the agreement on certain aspects of trade in agricultural products in the form of an exchange of letters between Charlene Barshefsky, Acting United States Representative, and Natan Sharansky, Minister of Industry and Trade, dated November 4, 1996 (the "Agreement").
1. Except as provided in paragraph 2 below, where Israel maintains a tariff-rate quota for a product pursuant to its schedule annexed to the General Agreement on Tariffs and Trade 1994 ("GATT 1994 schedule"), the quantity provided for that product in Annex B to the Agreement shall be in addition to the in-quota quantity provided under Israel's GATT 1994 schedule.
2. With respect to items 0406.3000, 0406.9000, 0806.2000 in Annex B, Israel may, consistent with the Marrakesh Agreement Establishing in World Trade Organization, count the quantities of these items specified in Annex B toward Israel's in quota quantity commitment for these items under its GATT 1994 schedule. Any such action shall not affect the United States' eligibility to supply potentially remaining available in-quota quantities for these items under its GATT 1994 schedule. Eighteen months after the date of entry into force of the Agreement , if the United States so requests, the United States and Israel hereby agree to conduct a joint review of the market access granted under the Agreement for U.S. wine products classified under Israeli custom tariff numbers 2204.2000, 2204.2100, 2204.2900, 2204.3000, 2205.1000, and 2205.9000 in order to determine if the terms of the Agreement are meeting the goal of improving market access for these wine products.
I have the honor to propose that this letter and your letter of confirmation in reply constitute an agreement between our tow governments, to enter into effect on the date that the Agreement enters into effect.

ATTACHMENT
1. The Government of Israel shall, with respect to products of the United States- -
(a) listed in Annex A, permit the importation into Israel free of any customs duty, fee, or other import charge Israel free of any customs duty, fee, or other import charge;
(b) listed in Annex B, permit the importation into Israel free of any customs duty, fee, or other import charge of not less than the quantity specified in that Annex for the applicable year and permit the importation of any quantity in excess of that quantity at a rate no greater than the rate specified in Annex C for the applicable year; and
(c) listed in Annex C, provide treatment no less favorable than that specified in that Annex.
2. With respect to any good within chapters 1 through 24 of the Harmonized System that is not listed in Annex A, B, or C, the Government of Israel shall permit its importation into Israel at a rate no greater than ninety percent of the rate applied at the time of importation to imports of that good from other countries. With respect to any agricultural product listed in paragraph 1 (ii) of Annex 1 or the Agreement on Agriculture annexed to the Marrakesh Agreement Establishing the World Trade Organization that is not listed in Annex A, B, or C of this agreement, the Government of Israel shall permit its importation free of any customs duty, fee, or other import charge.
3. The Government of the United States shall, with respect to products of Israel imported into the customs territory of the United States listed in Annex D, permit the importation free of any customs duty, fee or other import charge of not less than the quantity specified in that Annex for the applicable year. For products in Annex for the applicable year shall be no less favorable than what is specified in the U.S. WTO Schedule. The U.S. treatment of over-quota quantities for products of Israel imported into the customs territory of the United States of the type listed in WTO notifications G/AG/N/USA/2 dated March 8, 1995, and G/AG/N/USA/2 Add. 1, dated April 21, 1995, ("WTO notifications") that are not listed in Annex D, shall be no less favorable than what is specified in the U.S. WTO Schedule, and, as specified in the U.S.
4. The item numbers in Annexes A, B, and C refer to the item numbers in the 1996 Israeli Customs Tariff in effect on July 1, 1996. The item numbers in Annex D refer to the Harmonized Tariff Schedule of the United States (1996) in effect on January 1, 1996.
5. The in-quota quantity specified in column 4 of Annex B and column 4 of Annex D shall be available for the period beginning on the effective date of this agreement through December 31, 1996, and shall be calculated to include any quantity that was imported on or after January 1, 1996, free of any customs duty, fee or other import charge, except that:
(a) quantities of items 08.06.2000 and 08.13.2000 imported on or after January 1, 1996 shall be included in the in-quota quantity specified in Annex B, even if they were subject to customs duties, fees or other import charges; and
(b) notwithstanding the quantities specified in Annex B, the quantities available for 1996 for the following products are:
Ex 03.03.00 (fresh water) 33.3 tons
03.06.13 2.0 tons
03.07.50 1.0 tons
04.07.00 600,000 units
07.03.20 16.6 tons
Each successive annual quantity in Annex B or Annex D shall be made effective on January 1 of the applicable year.
6. For the products specified in Annex C, the Government of Israel shall not apply to a product of the United States in any year a rate greater than the lesser of:
(a) the most-favored-nation rate of customs duty applied by the Government of Israel as specified in Annex C; and
(b) the most-favored-nation rate of customs duty applied by the Government of Israel at the time of importation reduced by the percentage specified for that year in Annex C.
7. The Annexes to this Attachment are an integral part of this Attachment.
8. The term "customs duty, fee, or other import charge" shall not include any such charge--
(a) imposed pursuant to Article 4, 5, 7, 11, or 20 of the FTAA; or
(b) to the extent not inconsistent with the FTAA, permitted by the agreements listed in
Annex 1 to the Marrakesh Agreement Establishing the World Trade Organization, other than Article 5 of the Agreement on Agriculture.
