As you are aware,
Executive Order 12866, Regulatory Planning and Review, directs all Federal
agencies to periodically provide OMB/OIRA a listing of its planned
regulatory actions, indicating those which the agency has determined to be
significant as defined by the Order. The list allows OIRA greater
selectivity in reviewing regulations so that focus can be put on the more
important “significant” regulatory actions. The process also allows for the
expeditious publication of less important (not significant) actions because
those so designated do not require further OIRA review. The “regulatory
review cycles” which the Department established to comply with the
requirement continues to work well. Therefore, we will continue this
process and ask that you submit your planned rulemakings using the work plan
format.

Please note that we are entering the last year of an
Administration and agencies should plan their rulemakings accordingly. The
procedures for submitting actions via the workplan have not changed;
however, there has been one addition to the types of documents requiring
OMB/OIRA review – Guidance Documents. Workplans for Guidance Documents
should be prepared and submitted the same way as you prepare your existing
workplans and are due to OBPA on the same dates shown above. You are
reminded that a submission must be made to OMB for a planned regulatory
action at each stage of development (i.e., Advance Notice of Proposed
Rulemaking, Notice of Proposed Rule, an Interim Final Rule and a Final
Rulemaking).
Please continue your efforts in ensuring that
sufficient information, including a cost analysis statement and your
agency’s recommended designation is included under the description section
of the workplan so that OIRA can make an informed decision regarding the
rulemaking classification. Also, make sure that all required analysis for
each rulemaking is identified in the required analysis section. Remember,
providing sufficient information will help expedite the classification
process.
Finally, workplans must be submitted in one package by
the dates above in order to be processed for that cycle. OBPA will only
process workplans considered an “emergency” out of cycle.
