 DISPOSITION OF EQUIPMENT PURCHASED UNDER U.S. DEPARTMENT OF AGRICULTURE-FUNDED FOOD FOR PROGRESS PROGRAMS

The U.S. Department of Agriculture (USDA) is providing the following information regarding final budgetary disbursement and disposal of program equipment. DISPOSAL OF PROGRAM EQUIPMENT

For the purpose of Food for Progress and section 416(b) agreements, CCC follows sections 3019.34 and 3019.35 of 7 C.F.R. part 3019, Uniform Administrative Requirements for Grants and Agreements with Institutions of Higher Education, Hospitals, and Other Non-profit Organizations. These sections address requirements regarding retention and disposition of equipment and supplies that may be acquired by the Cooperating Sponsor with sales proceeds, program income, or CCC dollar grants. We have attached sections 3019.34 and 3019.35 together with section 3019.2, the applicable definitional section.

Section 3019.34(g)(4) provides that CCC may reserve the right to transfer title to equipment to the Federal government or a third party. Please note, in this regard, that CCC has specifically reserved the right to direct disposition of property in the event that a Cooperating Sponsor's participation in a project terminates. See 7 C.F.R. '1499.12(g) of the Food for Progress/section 416(b) regulations (61 F.R. 60519).
