7) LIGHTENING CLAUSE AT PORT OF AQABA: IN THE EVENT VESSEL ARRIVES AT THE
PORT OF AQABA WITH AN ARRIVAL DRAFT EXCEEDING 10.8 METERS SALT WATER, ALL
LIGHTENING OPERATIONS SHALL BE AT SHIP OWNER’S TIME, RISK AND EXPENSE. IN
THE EVENT OF FULL LIGHTENING AT THE PORT OF AQABA, LAYTIME SHALL COMMENCE AT
(0800) ON THE NEXT WORKING DAY AFTER DAUGHTER VESSEL(S) HAVE PRESENTED THEIR
NOTICE(S) OR READINESS TO DISCHARGE. IN THE EVENT OF PARTIAL LIGHTENING,
VESSEL WILL NOT BE CONSIDERED READY UNTIL OWNERS HAVE ARRANGED LIGHTENING
AND VESSEL HAS REACHED SAID DRAFT. ALL TIME LOST BEFORE VESSEL REACHES SAID

APPROPRIATE IN DETERMINING LOWEST LANDED LOST.
IF OWNERS INTEND TO LIGHTEN, THE OFFER IS TO STIPULATE THE COST OF

(B) FOR NON-U.S. FLAG VESSELS 95 PCT. OF THE TOTAL FREIGHT TO BE PAID UPON
VESSEL’S ARRIVAL AT DISCHARGING PORT AND 5 PCT. OF BALANCE OF FREIGHT WILL
BE PAID UPON SETTLEMENT OF DEMURRAGE OR DESPATCH UPON RECEIPT OF DISCHARGING
DOCUMENTS. CHARTERERS ARE RESPONSIBLE FOR OPENING FREIGHT LETTER(S) OF
CREDIT PRIOR TO THE CARGO BEING LOADED AT U.S PORTS OR CANADIAN
TRANSSHIPMENT POINTS THROUGH A U.S. BANKING INSTITUTION TO COVER THE PAYMENT

10) LAYDAYS WILL BE NON-REVERSIBLE FOR U.S. FLAG VESSELS AND REVERSIBLE FOR
NON-U.S. FLAG VESSELS.
11) DEMURRAGE/DESPATCH RATES TO BE STIPULATED IN OFFER WITH DESPATCH RATES
TO BE ONE-HALF OF DEMURRAGE RATE. IF FULL LIGHTENING AT DISCHARGE PORT
DEMURRAGE/DESPATCH RATE SHALL APPLY ONLY TO THE DAUGHTER VESSEL(S). IN CASE
OF FULL LIGHTENING, LAYTIME IS TO BE CALCULATED AS FOLLOWS: THE LAYTIME
USED BY EACH OF THE DAUGHTER VESSELS IS TO BE ADDED IN ORDER TO ARRIVE AT A
SINGLE FIGURE OF TIME LOST OR SAVED IN RELATION TO THE TOTAL TIME ALLOWED
FOR DISCHARGING SUCH LIGHTENING VESSELS. THE TIME SO LOST OR SAVED WILL
THEN BE DIVIDED BY THE NUMBER OF LIGHTENING VESSELS USED TO ARRIVE AT NET
TIME LOST OR SAVED AT DISCHARGE. REVERSIBLE LAY TIME (FOR NON-U.S. FLAG
VESSELS ONLY) SHALL BE COMPUTED COMPARING THE MOTHER VESSEL’S TIME AT LOAD
PORT(S) AGAINST THE NET TIME OF DAUGHTER VESSELS AT DISCHARGE PORTS.
12) FREIGHT OFFERS SHOULD NOT CONTAIN A “DETENTION” RATE. OFFERS WILL NOT
BE CONSIDERED NON-RESPONSIVE SOLELY BECAUSE A “DETENTION” RATE WAS GIVEN.
HOWEVER THE RELATED CHARTER PARTIES AND LINER BOOKING CONTRACTS MAY NOT
CONTAIN A “DETENTION” RATE.
13) VESSELS OFFERED WITH LAYDAY CANCELING LATER THAN THE DATES STIPULATED
ABOVE WILL NOT BE CONSIDERED RESPONSIVE TO THIS TENDER.
14) EXTRA INSURANCE:
A) ON U.S. FLAG VESSELS, ANY EXTRA INSURANCE ON CARGO AND/OR FREIGHT DUE TO
VESSEL’S AGE, CLASS OR TYPE TO BE FOR OWNER’S OR OWNERSHIP OF THE VESSEL’S
ACCT. BASIS NEW YORK MARKET RATE;
B) NON-U.S. FLAG VESSEL TO BE MAXIMUM TEN (10) YEARS OF AGE, CLASSED 100a1
LLOYDS REGISTER OR EQUIVALENT, BUT CHARTERERS MAY ACCEPT OLDER VESSELS UP TO
20 YEARS OLD PROVIDED ANY EXTRA INSURANCE PREMIUM DUE TO VESSEL’S AGE TO BE
FOR OWNER’S ACCOUNT. ANY EXTRA INSURANCE ON CARGO AND FREIGHT DUE TO VESSEL
’S AGE (OVER 10 YEARS) OR TYPE TO BE FOR OWNER’S ACCOUNT BASIS LLOYDS OF
LONDON PLUS 10 PCT. SUCH PREMIUMS TO BE PAID BY SHIPOWNER TO CHARTERERS
AGAINST CHARTERERS’ INVOICE WITH SUPPORTING STATEMENT FROM THEIR INSURANCE
COMPANY. VESSELS OVER 20 YEARS OF AGE AND ITBS TO PROVIDE ADDITIONAL
CERTIFICATION FROM NCB CERTIFYING THAT VESSEL’S HATCH COVERS AND ANY OTHER
OPENING LEADING TO CARGO COMPARTMENTS HAVE BEEN SEALED TO PROTECT ANY
OUTSIDE WATER FROM ENTERING THE CARGO COMPARTMENTS.
15) VESSELS MUST BE ABLE TO BE FUMIGATED WITH AN ALUMINUM PHOSPHATE
PREPARATION IN-TRANSIT IN ACCORDANCE WITH THE USDA, FGIS FUMIGATION HANDBOOK
AND VESSELS THAT CANNOT BE SO FUMIGATED WILL NOT BE CONSIDERED. AT FINAL
LOADING PORT, COMMODITY SUPPLIER WILL ARRANGE AND PAY FOR IN-TRANSIT
FUMIGATION PERFORMED BY A CERTIFIED APPLICATOR IN ACCORDANCE WITH THE USDA,
FGIS FUMIGATION HANDBOOK. FUMIGATION MUST BE WITNESSED BY FGIS, USDA, AND
THE ALUMINUM PHOSPHIDE PREPARATION MUST BE CONTAINED IN PACKAGING AS
DESCRIBED IN THE FUMIGATION HANDBOOK. DUST RETAINERS MUST BE USED. FOR
TWEEN-DECKERS AND BULK CARRIERS (INCLUDING PUSH MODE ITB’S) THE
RECIRCULATION METHOD OF FUMIGATION WILL BE USED. FOR TANKERS AND TUG BARGES
OTHER THAN PUSH MODE ITBS SURFACE APPLICATION WILL BE USED.
TWEEN-DECK VESSELS WILL BE CONSIDERED PROVIDED THEY ARE ACCEPTABLE FOR
IN-TRANSIT FUMIGATION IN ACCORDANCE WITH USDA. FGIS FUMIGATION HANDBOOK.
OFFERS OF SUCH TWEEN-DECK VESSELS MUST BE ACCOMPANIED BY A COPY OF A LETTER
FROM FGIS, USDA STATING THAT THE VESSEL CAN BE FUMIGATED UNDER THE FGIS IN
TRANSIT FUMIGATION PROCEDURES.
IN ADDITION, TWEEN-DECK VESSELS ARE ACCEPTABLE ONLY WHEN A CERTIFIED
APPLICATOR STATES THAT THE VESSEL HAS BEEN INSPECTED AND FOUND TO BE
SUITABLE FOR FUMIGATION AND SUCH WRITTEN STATEMENT FROM CERTIFIED APPLICATOR
MUST BE SUBMITTED WITH OFFER.
VESSELS MUST HAVE ALL OPENINGS TO CARGO SPACES AND HATCH COVERS SUITABLY
SEALED WITH TAPE OR OTHER MEANS TO ASSURE WATER TIGHT INTEGRITY. THE
SEALING SHALL BE DONE TO THE SATISFACTION OF NCB SURVEYOR OR AS ATTESTED BY
CERTIFICATION OF SPECIAL SURVEY. ALL OF THE ABOVE TO BE PERFORMED AT VESSEL
’S TIME, RISK AND EXPENSE. SPECIAL SURVEY CERTIFICATE WILL BE REQUIRED AS A
CONDITION OF FREIGHT PAYMENT. SEALINGS OF HATCHES/OPENINGS AND SPECIAL NCB
CERTIFICATE IN NO WAY DIMINISHES OWNERS’ RESPONSIBILITY AND LIABILITY TOWARD

16) AT DISCHARGE PORT, AND UPON INSPECTION BY GOVERNMENT
INSPECTORS, IF CARGO AND/OR VESSEL IS FOUND TO BE INFESTED
AND PROVIDED CLEAN B’S/L WERE ISSUED, FUMIGATION COST IF ANY,
ARE FOR OWNERS ACCOUNT. TIME WILL COUNT ON U.S. FLAG
VESSELS; TIME WILL NOT COUNT ON NON-U.S. FLAG VESSELS.
17) ONE-WAY RATES MUST BE QUOTED IN ADDITION TO ROUND TRIP RATES FOR U.S.
NON-LINER VESSELS WHOSE DATE OF ORIGINAL CONSTRUCTION EXCEED 15 YEARS FROM
DATE OF FIXTURE.
18) U.S. FLAG OFFERS WILL NOT BE CONSIDERED IF VESSEL OPERATOR HAS NOT
PROVIDED MARAD WITH THE VESSEL COSTS PRIOR TO SUBMISSION OF OFFER.
19) U.S. FLAG VESSELS APPROVED RATE(S) WILL BE REDUCED TO NO HIGHER THAN

20) U.S. FLAG VESSELS WHICH REQUIRE PRIOR APPROVAL FROM MARAD TO PARTICIPATE
IN PREFERENCE CARGOES BECAUSE OF OPERATING DIFFERENTIAL SUBSIDY (DDS),
CONTRACTUAL RESTRAINTS, OR BECAUSE OF REFLAGGING/FOREIGN CONSTRUCTIONS
ISSUES, MUST OBTAIN SUCH MARAD APPROVAL PRIOR TO SUBMISSION OF BIDS.
